General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (hereinafter "GTC") govern the contractual relationship between Edu-Migrate (hereinafter "Provider") and the users (hereinafter "Customers") of the services offered via the website www.edu-migrate.com. By using our services, the Customer agrees to these GTC.

2. Subject of the Contract

The Provider offers services in the field of study and migration consulting via the website www.edu-migrate.com, in particular support with applications to foreign educational institutions, visa applications, accommodation search, and other related consulting and support services. The exact scope of services results from the respective service description on the website and/or individual offers.

3. Conclusion of the Contract

The presentation of services on the website does not constitute a legally binding offer, but an invitation to submit an offer by the Customer. The contract is concluded when the Customer submits a binding offer (e.g., by filling out a registration form or confirming an individual offer) and the Provider accepts this offer (e.g., by a written order confirmation).

4. Prices and Payment Terms

The prices stated on the website or in individual offers are final prices. All payments are to be made according to the agreed payment terms. In case of default of payment, the Provider is entitled to charge default interest and reminder fees.

5. Obligations of the Customer

The Customer is obliged to provide all information and documents necessary for the provision of the service completely and truthfully. The Customer is responsible for the accuracy and completeness of his information. Any delays or additional costs arising from incomplete or incorrect information shall be borne by the Customer.

6. Withdrawal and Termination

The conditions for withdrawal or termination of agreed services are governed by the Provider's separate refund policy, which can be viewed on the website. In the event of termination by the Customer, cancellation fees may apply.

7. Liability of the Provider

The Provider is liable for damages based on an intentional or grossly negligent breach of duty by the Provider, its legal representatives, or vicarious agents. For slight negligence, the Provider is only liable for the breach of an essential contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the Customer may regularly rely (cardinal obligation). In this case, liability is limited to the foreseeable damage typical for the contract.

The Provider does not guarantee the success of applications, visa applications, or similar processes, as these depend on the decisions of third parties (e.g., universities, authorities). The Provider's services are limited to advice and support within the scope of possibilities.

8. Data Protection

The Provider processes the Customer's personal data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the national data protection laws of Cyprus. Details on this are regulated in the Provider's Privacy Policy on the website www.edu-migrate.com.

9. Changes to the GTC

The Provider reserves the right to change these GTC at any time with effect for the future. The Customer will be informed of changes in good time. If the Customer does not object to the changes within a reasonable period after receipt of the notification of change, the amended GTC shall be deemed accepted. The Customer will be separately informed of the right to object and the consequences of silence in the notification of change.

10. Applicable Law and Place of Jurisdiction

The law of the Republic of Cyprus applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Paphos.

11. Severability Clause

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected thereby. The invalid provision shall be replaced by the valid provision that comes closest to the economic purpose of the invalid provision.
